WHDI Member Jason E. Reisman of Blank Rome LLP’s Philadelphia office, conducted an HR Round Table with the members of the Manufacturing Alliance of Philadelphia on November 11, 2015. The program focused on wage-and-hour hot topics, including the U.S. DOL’s proposed regulations to update the “white collar exemptions” and providing practical advice to evaluate and minimize risk related to potential misclassification and off-the-clock work. The Manufacturing Alliance of Philadelphia is a non-profit trade organization created to give voice to the owners and employees of the critical manufacturing sector in the Philadelphia region. On September 4, 2015, the WHDI filed formal comments to the DOL's proposed regulations which may increase the salary level for white collar exempt employees. In their comments, the WHDI explains that the proposed regulations do not simplify the interpretation of the FLSA, are seriously flawed, will lead to more, not less, litigation, have significant hidden administrative and employee morale costs, and, contrary to impression created by publicity, do not obligate employers to increase an employee’s total compensation under the FLSA when converting from exempt to non-exempt status. WHDI Chair-Elect Joseph Tilson, of the Chicago office of Cozen O’Connor, was featured in a recent edition of the Chicago Law Bulletin for his role as lead counsel for Northwestern University in the high-profile matter recently decided by the National Labor Relations Board. In that decision, the NLRB held that Northwestern University’s football players were no eligible to organize for the purpose of collective bargaining. (August 2015)

Members of the WHDI met for two days in May at the Boston office of Foley Hoag, hosted by WHDI Chair Jonathan Keselenko, for its Sixth Annual Conference. WHDI Member Robert Boonin of Dykema Gossett, PLLC Gossett’s Ann Arbor and Detroit offices published an article in the January 2015 issue of Metropolitan Corporate Counsel on the US Supreme Court’s unanimous decision holding that employees need not paid for time waiting for and going through security checks at the ends of their shifts. The WHDI held its Annual Conference at the office of Paul, Plevin, Sullivan and Connaughton in San Diego on March 27-28, 2014. Hosted by the WHDI Members Fred Plevin and Aaron Buckley, sixteen WHDI Members attended and in-depth discussions were held on various substantive topics. Two sessions involved guest speakers. One guest was the nationally renowned class action mediator, Mark Rudy, who led a discussion of mediation issues and trends. Other guests were Ted Anderson and Nathan Woods of Welch Consulting who discussed strategies for compiling and presenting data in collective and class actions. Other discussions were led by members, including Andy Naylor of the Nashville office of Waller Lansden Dortch & Davis on issues to consider while drafting settlement agreements, Mike Killeen of the Seattle office of Davis Wright Tremaine on trends in USDOL enforcement actions, and Joe Tilson of the Chicago office of Meckler, Bulger, Tilson, Marick and Pearson on the status of donning and doffing since the Supreme Court’s Sandifer decision. The WHDI also addressed business issues of the Institute during the meeting. (April 2014)

The WHDI is pleased to present the latest installment of its webinar series entitled "Quarterly Update on Developments in Wage & Hour Law" on October 9, 2013 at 12:00 pm -1:00 pm EST. WHDI Member John Ho of Bond, Schoeneck & King’s New York City office presented the Closing General Session of the 2012 HCP Annual Management Conference and Exhibition which was held from October 16-18, 2012 in Hilton Long Island/Huntington, Melville, NY. The presentation is entitled, "Hot" Wage and Hour Issues in the Health and Home Care Industry & The New "Wage Parity Law" for Home Health Aides. The first portion of the session addressed Wage and Hour issues common to home care employers, such as "employee misclassifications," "off-the-clock work," travel and meal time compensation, live-in wage rates, plus the impact of the recent "Wage Theft Prevention Act." The second portion of the session addressed the requirements of the newly-enacted "Wage Parity Law," applicable to home care workers, and what exemptions may be available to employers. WHDI Member Susan Eisenberg of Akerman Senterfitt’s Miami office prepared “A WHDI Supreme Court Review” summarizing and analyzing the June 18, 2012 Supreme Court decision in Christopher v. SmithKline Beecham. This case is significant for at least two reasons. First, by a 5-4 vote, the Court ruled that pharmaceutical sales representatives may qualify as “outside sales employees” and therefore be considered exempt from the FLSA’s overtime pay requirements. Second, the Court unanimously indicated that the Department of Labor’s position on this matter was not entitled to any deference. (June 2012)

The paper and presentation focused on recent decisions involving FLSA collective actions, off-the-clock work disputes, misclassification of exempt employee issues, resolving overtime claims and managing internal wage/hour practice audits.
